Acceptance of Terms and Service Definition

All account holders must accept these Terms of Service before registering. By using the service, you fully accept these terms.

For purposes of this agreement, the service means access to a user account on the Giftcarder web platform and the standard use of its features.

Disclaimer of Warranties and Limitation of Liability

The service is provided without any warranties or commitments regarding availability, performance, or service levels, to the maximum extent permitted by law, notwithstanding the provider’s best efforts to ensure security and data preservation. This provision does not affect statutory user rights that cannot be contractually excluded.

The service provider assumes no liability of any kind, including direct, indirect, incidental, consequential, or other damages. Any liability of the provider is excluded to the maximum extent permitted by law.

Accounts and Payments; Suspension and Termination

Payments are processed through the Stripe payment gateway under the available plans. Account holders may cancel their subscription at any time. When payment ends or plan limits are exhausted, the account becomes inactive. Inactive accounts may redeem existing gift cards but cannot create new ones.

As a general practice, the provider does not terminate accounts sooner than three months after the end of the last active subscription. At the same time, the provider reserves the right to terminate or deactivate any account at any time, at its sole discretion, without stating a reason and without any obligation to disclose or justify the circumstances of such a decision.

All payments are final. No refunds are provided under any circumstances.

Data and Backups; Client Accounts

The service provider bears no responsibility for any data, including accuracy, loss, damage, unauthorized access, misuse, or actions of third parties. Account holders must maintain their own independent backups and use the service entirely at their own risk.

Account holders are solely responsible for all client accounts they or their clients create. The service provider bears no legal or operational responsibility for any relationships or obligations between account holders and their clients.

The service provider may use the account holder’s data for any purpose.

Intellectual Property and License

  • All software, code, interfaces, layouts, trademarks, and brand elements remain the exclusive property of the service provider.
  • Account holders receive only a limited, revocable, non-exclusive, and non-transferable right to access the service.
  • Reverse engineering, copying, resale, or attempts to obtain the source code are strictly prohibited.

Individual Contractual Arrangements

Account holders may negotiate custom operational terms of the service without limitation. This includes priority support, adjusted pricing models, and customization.

  • Support for operating on a custom domain or multiple domains.
  • Enhanced performance parameters and dedicated resources.
  • Custom graphics, interface, branding elements, and user experience.
  • Specific requirements for availability, SLA, monitoring, and response times.
  • Rules for data management, backups, retention, and recovery.
  • Individual arrangements take precedence over the general Terms of Service.

Changes to the Service, Pricing, and These Terms

  • The service provider may modify features, pricing, limits, rules, or any aspect of the service at any time without prior notice.
  • The service provider may change these terms at any time. The currently published version is always valid and binding, regardless of the version in effect at the time of registration.
  • Translations of these terms may be outdated. In case of discrepancies, the current English version of the terms always prevails.

Governing Law and Dispute Resolution

No obligation arises to submit to arbitration, courts, or any formal dispute process. Account holders accept the service as is and use it at their own risk.

No specific jurisdiction is designated. Using the service constitutes acceptance that the provider bears no legal responsibility beyond mandatory provisions of law that cannot be waived.
